214 ORDER POLICIES INTERNET MINIMUM ADVERTISED PRICE (IMAP) POLICY Jetta supports and encourages online advertising and promotion of Jetta products by our distributors and dealers. This policy details acceptable online practices to ensure that the sales and marketing efforts of all of our valued distributors and dealers are respected. This policy applies to all products produced and sold by Jetta Corporation. • The minimum advertised price for Jetta distributors and dealers on the Internet shall be 25% off the Manufacturer’s List Price (MLP) as established by Jetta Corporation. • This policy applies only to advertised prices and does not affect the Jetta distributor or dealer’s right to set sell prices in their respective markets. • This policy does not establish maximum advertised prices. Distributors and dealers may advertise Jetta bathtub products at prices higher than MLP. • Jetta reserves the right to adjust or change MLP pricing on any bathtub model at its sole discretion • From time to time, Jetta may discontinue or phase out bathtub models or engage in promotions on certain products. In such event, Jetta reserves the right to modify or suspend this IMAP policy with respect to the affected models by notifying distributors and dealers of such a change. • Any distributors and dealers who violate this policy will have 24 hours after notification by Jetta to bring their advertising into compliance or Jetta may, at its discretion, discontinue supplying product to the distributor or dealer. • Internet sales and marketing activities are intended for application in the distributors and dealers primary trade area. Jetta reserves the right to refuse drop shipment of sold products into markets with established Jetta distribution. PRODUCT SPECIFICATIONS PRODUCT DIMENSIONS AND DESIGN • While every effort will be made to produce products exactly as detailed in product specification documents some manufacturing variation is common and production tolerances can be +/- 1/2”. • Minor product design elements are subject to change without notice. Major changes that significantly alter a product’s appearance or application will be communicated through a Jetta email. CONSTRUCTION CODES • Given the wide variation in construction codes throughout the country it is the responsibility of the Distributor or Contractor to confirm compliance with any applicable code regulation. • Jetta cannot assure code compliance and will not be responsible for any local dispute. WARRANTY LIMITATIONS • The Jetta standard warranty is limited to the original owner and is not transferable. • Jetta Corporation reserves the right, at its option to a) repair or replace the defective unit b) repair or replace the defective components, or c) replace with an equal-valued unit. • This warranty may not be amended by any party other than Jetta Corporation, and this remains the sole warranty for Jetta Corporation baths. • This warranty covers only factory installed accessories. WARRANTY EXCLUSIONS • Jetta Corporation warranties do not cover defects due to shipping damage, installation errors, use other than intended purposes, abuse, misuse, failure to provide maintenance and / or cleaning as directed in the Owner’s Manual, accident or acts of God. Any modifications, alterations, or customization made by an unauthorized service representative or without authorization by Jetta Corporation will result in warranty becoming null and void. • This warranty does not cover costs associated with installation, removal, or installation of replaced unit. • This warranty does not include freight charges associated with return of components or unit for repair nor freight charges associated with replacement components or unit. • The warranty does not include any costs associated with electrical or plumbing modifications. • The forgoing warranty is exclusive and in lieu of all other warranties, including any other warranty of quality, express or implied, and any warranty of merchantability, or warranty of fitness for any particular use.
